By accessing or using our platform, purchasing any course or package, or participating in our affiliate program, you agree to be bound by these Terms & Conditions ('Terms'). These Terms apply to all users of the platform including learners, affiliates, content promoters, and visitors.

Please read these Terms carefully before using the platform. If you do not agree with any part of these Terms, you must not access or use ApexDhan. Continued use of the platform after any updates to these Terms constitutes your acceptance of the revised Terms.

1. Definitions

• •"ApexDhan" refers to the ApexDhan platform, its website (www.apexdhan.com), services, digital content, and team.
• •"User" refers to any individual who accesses, registers on, purchases from, or interacts with the ApexDhan platform in any capacity.
• •"Affiliate / Partner" refers to users who participate in the ApexDhan Refer & Earn program and promote courses through a personal referral link.
• •"Course / Content" refers to any digital educational material, video, PDF, resource, or training available on the platform.
• •"Platform" refers to the ApexDhan website and any associated applications or services.

2. Acceptance of Terms

By accessing or using ApexDhan in any manner — including browsing, registering, purchasing, or sharing content — you confirm that you have read, understood, and agreed to these Terms & Conditions, along with the Privacy Policy, Refund & Cancellation Policy, and Disclaimer available on www.apexdhan.com.

If you are accessing the platform on behalf of an organisation, you represent that you are authorised to bind that organisation to these Terms.

3. Eligibility

• •You must be at least 18 years of age to independently register and use the ApexDhan platform.
• •Users below 18 years must access the platform only under the supervision of a parent or legal guardian.
• •By registering, you confirm that you are legally capable of entering into a binding contract under applicable Indian law.
• •ApexDhan reserves the right to refuse access to any user at its sole discretion.

4. Account Registration

• •Users must provide accurate, complete, and up-to-date information during registration.
• •You are solely responsible for maintaining the confidentiality of your account credentials.
• •Sharing your login credentials with any other person is strictly prohibited.
• •Any activity that occurs under your account is your sole responsibility.
• •If you suspect unauthorised access to your account, you must notify us immediately at Support@apexdhan.com.
• •ApexDhan reserves the right to suspend or terminate accounts that contain false or misleading information.

5. Course Access & Usage

Upon successful payment, you are granted a non-exclusive, non-transferable, personal licence to access your enrolled course(s) for the duration specified at purchase (lifetime access unless otherwise stated).

You may NOT:

• •Copy, reproduce, screen-record, download, redistribute, or resell any course content or part thereof.
• •Share your login credentials or grant access to any other individual.
• •Upload, transmit, or publish any ApexDhan content on third-party platforms, social media, or any other medium without prior written permission.
• •Use course content for commercial purposes outside of what is explicitly permitted.

Violation of this clause will result in immediate termination of access without refund and may lead to legal action under applicable intellectual property laws.

6. Pricing & Payments

• •All prices listed on the platform are in Indian Rupees (₹) and are inclusive of applicable taxes unless stated otherwise.
• •Payments are processed through secure third-party payment gateways. ApexDhan does not store any card, UPI, or banking details on its servers.
• •In the event of a payment failure or double charge, please contact Support@apexdhan.com with your transaction details within 24 hours.
• •ApexDhan reserves the right to modify course pricing at any time without prior notice. Existing purchases will not be affected by price changes.

7. Refund & Cancellation Policy

Refund requests are governed by the ApexDhan Refund & Cancellation Policy available at www.apexdhan.com/refund-policy. Key points:

• •Refund requests must be submitted within 24 hours of purchase via email to Support@apexdhan.com.
• •Refunds are only applicable if less than 10% of the course content has been accessed.
• •Approved refunds are subject to deduction of payment gateway fees (5%), administrative charges (5%), and any affiliate commissions earned.
• •No refunds will be issued after the 24-hour window under any circumstances.

8. Affiliate & Refer & Earn Program

ApexDhan operates a Refer & Earn affiliate program open to all enrolled users. By participating in this program, you agree to the following:

• •You may only promote ApexDhan through your personal referral link provided in your dashboard.
• •You must not make false, misleading, or exaggerated claims about ApexDhan courses, income potential, or results in your promotions.
• •You must not use ApexDhan's logo, branding, or copyrighted material in any advertisement or video without prior written approval.
• •You must not represent yourself as an official employee or spokesperson of ApexDhan.
• •Commission rates, tier structures, and payout timelines are subject to change at ApexDhan's sole discretion with or without prior notice.
• •Commissions earned on refunded purchases will be reversed from your wallet.
• •ApexDhan reserves the right to suspend or terminate affiliate accounts found engaging in spam, fraud, or unethical promotional practices.

9. Intellectual Property Rights

All content available on the ApexDhan platform — including but not limited to videos, PDFs, course material, graphics, logos, branding, website design, scripts, and text — is the exclusive intellectual property of ApexDhan.

• •No content may be reproduced, modified, distributed, or used without express written permission from ApexDhan.
• •Unauthorised use of ApexDhan's intellectual property may result in civil and/or criminal proceedings under the Copyright Act, 1957 and other applicable Indian laws.
• •By submitting testimonials, reviews, or feedback on the platform, you grant ApexDhan a non-exclusive, royalty-free licence to use such content (including first name and city) in promotional and marketing materials.

10. User Conduct & Prohibited Activities

While using the ApexDhan platform, you agree not to:

• •Upload, post, or transmit any content that is unlawful, defamatory, harassing, abusive, fraudulent, or harmful.
• •Attempt to gain unauthorised access to any part of the platform, server, or database.
• •Reverse engineer, scrape, or extract data from the platform by automated or manual means.
• •Use the platform to send unsolicited messages (spam) or conduct phishing activities.
• •Engage in any activity that disrupts or interferes with the functionality or security of the platform.
• •Violate any applicable local, national, or international laws or regulations.

ApexDhan reserves the right to immediately suspend or permanently terminate the account of any user who violates this section.

11. Third-Party Services & Links

ApexDhan may integrate or link to third-party tools and services such as payment gateways, video hosting platforms, analytics tools, or communication services. ApexDhan is not responsible for:

• •The privacy practices, data handling, or terms of any third-party service.
• •The accuracy, availability, or reliability of third-party platforms.
• •Any loss or damage arising from your use of third-party services linked through ApexDhan.

12. Privacy & Data

ApexDhan collects and processes user data including name, email address, phone number, and activity data for the purpose of providing and improving its services. 13. Disclaimer of Warranties

The ApexDhan platform and all its content are provided on an "as is" and "as available" basis without warranties of any kind, express or implied. ApexDhan does not guarantee:

• •That course content will meet every user's specific requirements or expectations.
• •Any specific income, career outcome, or financial result from the use of our courses or affiliate program.

Results vary significantly based on individual effort, experience, and market conditions.

14. Limitation of Liability

To the fullest extent permitted by applicable law, ApexDhan and its directors, employees, affiliates, and partners shall not be liable for any:

• •Direct, indirect, incidental, consequential, or punitive damages.
• •Loss of data, profits, revenue, or business opportunities.
• •Financial losses arising from actions taken based on course content or affiliate earnings.
• •Unauthorised access to or alteration of user data.

This limitation applies regardless of the legal theory under which the claim is brought.

15. Termination of Access

ApexDhan reserves the right to restrict, suspend, or permanently terminate access for any user who:

• •Violates any provision of these Terms & Conditions.
• •Engages in fraudulent, abusive, or unlawful activity on the platform.
• •Misuses the affiliate or referral program.
• •Provides false information during registration or purchase.

Termination does not entitle the user to any refund unless explicitly covered under the Refund Policy.

16. Force Majeure

ApexDhan shall not be held liable for any failure or delay in performance resulting from causes beyond its reasonable control, including but not limited to:

• •Natural disasters or acts of God
• •Internet or server outages
• •Government orders or regulatory restrictions
• •Cyber-attacks or third-party platform failures

17. Modifications to Terms

ApexDhan reserves the right to update, modify, or replace these Terms & Conditions at any time without prior notice. The revised Terms will take effect immediately upon being published on www.apexdhan.com. It is your responsibility to review these Terms periodically. Continued use of the platform after any changes constitutes acceptance of the updated Terms.

18. Governing Law & Jurisdiction

These Terms & Conditions are governed by and construed in accordance with the laws of India. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts of India.
